Thank you for your interest in a career within L’Occitane Group. The purpose of this Privacy Policy is to inform you, as a candidate applying for a position within L’Occitane Group, about how L’Occitane (“L’Occitane”, “we”, “us” and “our”), collects and will process your personal data. “Personal data” means any information that can identify you, directly or indirectly, collected by or provided to L’Occitane.
Please carefully read this Privacy Policy relating to the Personal Data provided when using our career website. It describes the categories of Personal Data collected and explains how we process and protect this data, as well as your rights in this regard.

1.  Categories of Personal data that may be processed   

To tailor our communication, and in particular information linked to one or several job opportunities proposed by L’Occitane and/or our subsidiary companies, we may ask you to provide personal information. According to the opportunities you select, you will be asked to provide mandatory and optional information.

We may collect personal information from you when you: 

  • Visit our website;
  • Create an account on our website;
  • Create an alert,  send us a speculative application or apply for a job;
  • Contact us (for example, when you send us emails or use the contact form);
  • In the frame of your application management and its assessment;
  • Have given your consent to third parties such as recruitment agencies, job boards or social networks (LinkedIn, etc.) to send us personal information about you. If you choose to interact with us via a social media platform or other third-party services, we may process the information you have provided to us through that platform. 

For the purposes referred in next paragraph below, the processing of Personal Data may include the following:

  • Data related to your identity (surname, name(s), address, date and place of birth, nationality, gender, phone number, email address, etc.);
  • Your photo, if voluntarily provided (i.e. included in your cv);
  • Data related to your professional experience (profile, data on previous employers, duration of previous employment, job responsibilities and any project work) as well as contact details for references. Please note that if you provide details for references you thereby consent for us to contact relevant previous employers, apart from your current employer;
  • Data with regard to your education (diploma’s, certificates, internships, special training);
  • Languages spoken ;
  • If applicable, whether you possess a work permit and/or reside in the European Economic Area (EEA);
  • Technical data, related to your browsing on our website, such as your IP address or information related to your device;
  • Any other personal data that you provide as part of your application;
  • Data related to digital or psychometric tests or assessment (e.g. via recruitment platforms or professional social media accounts) where this information is made available;
  • Data collected via digital tests or assessments made by L’Occitane for the assessment of your application, particularly regarding your personality, needs and drives in relation with the job and your career;
  • Any other personal data (other than mentioned above) that requires processing according to applicable laws.

If you do not wish some of this personal data to be collected and processed in the manner described in this Privacy Policy, we may be unable to respond to some of your requests.

 

2.  Purpose and legal grounds for the processing of your personal data

The purpose for processing your Personal Data is to: 

  • Register your application for a position in our Group;
  • Manage your application and for recruitment activities necessary to respond to your request or for the purposes of our legitimate interest to assess your application in view of a potential recruitment ;
  • Deal with your enquiries and requests;
  • Send service-related information, such as job alerts, according to your selection and preferences, as well as administrative messages such as password change requests, etc.;
  • As part of our recruitment platform security measures;
  • For website administration and improvement of the quality of service. This processing is necessary for the purposes of the legitimate interest referred to above. 

We do not base hiring decisions solely on automated processing of your personal data. “Automated decision” means a decision about individuals that is based solely on the automated processing of personal data and which have a legal or similarly significant effect on them. Particularly, through the assessment of your personality, needs and qualities in relation with a job or your career management through our dedicated solutions, a HR Team member will always be involved in the realisation of the assessment, interpretation of results and formulation of potential recommendations. In case such automated decision processing would ever be implemented, this would only be done either for the purpose of conclusion or execution of an agreement, in the frame of specific legal requirements or based on your prior express consent and you will always have the possibility to ask for review of such decision by one of our teams’ member.

 

 3.  Access to your personal data and possible transfers

The Human Resources department and potential managers will have access to your Personal Data strictly for the purposes described above. As part of an international Group that operates in many countries, we may communicate your personal data to other L’Occitane Group companies, if necessary.

It may also be shared with relevant service providers chosen for their expertise and reliability and acting on our behalf and upon our instructions to process your Personal Data, only as necessary to perform services on our behalf (hosting, recruitment services, research analysis, etc), according to the present Privacy Policy or to comply with legal requirements.

Some of these affiliated companies and service providers may be located out of the European Economic Area. In case of transfer of your information to countries that do not beneficiate from an adequacy decision in relation with personal data protection, we will ensure either:
To enter into appropriate data transfer agreements conforming to the Standard Model Clauses established by the European Commission.

To ensure that those transfers and third parties comply with appropriate safeguards.

We draw your attention to the fact that your use of other websites such as job boards or professional social networks (LinkedIn, etc.) is exclusively governed by the terms and conditions of those third party sites. Please read and refer to the relevant terms carefully and regularly.

 

4.  Our policy relating to minors

Our website and this platform is not aimed at minors and we do not knowingly collect nor process personal information from minors.

6.  Duration of processing and retention of your personal data

We will only keep your personal data for the time necessary for the purposes set out in this privacy policy and in accordance with the provisions in force.

In case of unsuccessful application, your personal data will be kept for a maximum period of two years from the last contact with you, unless you object to this retention period and ask for the deletion of your personal data (see section 8: Your rights & personal data deletion requests).

Upon termination of this period, we may contact you again to find out if you want us to keep you on file. In the absence of consent from you, we will then remove the personal data from our systems or permanently and in an irreversible way make it anonymous for statistical purposes, meaning that you cannot be associated to it.

In case of successful application, data will be kept for the duration of your employment contract with the Group and according to the applicable laws.

Data relating to identity documents prior to employment may be kept for one year to facilitate rightful access, rectification or portability and three years for personal request.

Where required to prove a legal or contractual right, or in compliance with a legal obligation, your Personal Data can be archived in accordance with applicable laws.

 

7.  Protecting your Personal Data


We commit to implement appropriate technical and organisational measures in order to protect your Personal Data against accidental or involuntary destruction, accidental loss, alteration, and any unauthorised disclosure, access or usage.

 

8. Your rights & personal data deletion requests


You can change your preferences at any time, including unsubscribing from your alerts in your candidate area.
In accordance with applicable laws, you have a right to access, rectification, erasure and portability of your personal data as well as a right to object and restriction of processing. You can also withdraw your consent at any time.
To exercise these rights or in case of any question about the processing of your personal data by L’Occitane, please send your request directly to our Data Protection Officer at the following email address: dpo@loccitane.com. Especially, any erasure request of your candidate account and related personal data must be directly sent to our data protection officer, using the above email address, to ensure appropriate measures are taken as per such request
In accordance with applicable laws, we may ask you to confirm your identity (with contact details & information on related job(s) application(s)) based on bespoke questions or by requesting relevant identification information or documents, in order to ensure protection of your Personal Data.
We will then inform you about the actions undertaken as soon as possible and in any case no later than one month following your request, except in case of unfounded or excessive requests.
In accordance with applicable laws, you can also file a complaint with the relevant data protection authority.
